RiserNest Terms of Service

Welcome to RiserNest! These Terms of Service govern your access to and use of the RiserNest platform, which includes two distinct applications: the Dashboard Application (DAPP) and the Community Application (CAPP). These terms apply to the usage of RiserNest on all platforms, including web, mobile applications, Windows, and Mac software. Please review the specific terms that apply to the platform you are using.

Definitions

  • RiserNest: RiserNest is a platform designed to manage communities for companies, allowing effective communication, collaboration, voting, issue handling, and payments within a structured environment. RiserNest is only available to authorized consulting firms that use the platform to manage their client communities. It provides two core applications—DAPP and CAPP—that serve different purposes for community managers and members.

  • Dashboard Application (DAPP): DAPP refers to the administration interface of the RiserNest platform used by community admins and managers. It enables them to manage community members, staff, events, payments, voting, issues, and overall community operations.

  • Community Application (CAPP): CAPP is the private social network part of RiserNest, where community members (invited by admins through DAPP) interact with each other. CAPP allows members to participate in events, votes, issue submission, and engage with posts, comments, and financial transactions related to their membership.

  • Admin: The Admin is the first person who creates an account on the Dashboard Application (DAPP). This individual is considered the community manager and holds primary responsibility for the overall management and administration of the community. The Admin may add other staff members to assist in managing the community and its operations.

  • Advisor: An Advisor is a user invited by either the Admin or staff members to provide expert consulting or advisory services within the CAPP. Advisors may be assigned to specific companies or community members to address their unique needs. Admins are fully responsible for the eligibility of the advisors and the accuracy and appropriateness of the advice they provide. Advisors may offer consulting or guidance related to community matters, and it is the Admin’s duty to ensure they comply with all applicable guidelines and regulations.
  • DAPP User: A DAPP user is a community admin or manager who uses the Dashboard Application (DAPP) to manage and oversee the community. This includes responsibilities such as member management, staff management, event creation, payment processing, and resolving issues within the community.

  • CAPP User: A CAPP user is a member of the community who uses the Community Application (CAPP) to engage with the community. This user is typically an employee, resident, or participant who interacts with other members, participates in voting, joins events, and manages issues.

1. Acceptance of Terms

By accessing or using RiserNest on any platform, including web browsers, mobile applications, Windows, and Mac software, you agree to comply with these Terms of Service (“Terms”). RiserNest is exclusively available to authorized consulting firms that manage client communities. You must be an authorized representative of a consulting firm or a community invited by an authorized firm to use the platform.

RiserNest reserves the right to modify these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.

2. Terms for DAPP Users

The Dashboard Application (DAPP) is designed for community admins and managers to oversee and manage their communities. This section applies specifically to DAPP users.

2.1 Account Registration

Only authorized company representatives and community managers from authorized consulting firms may create accounts in DAPP. You are responsible for all actions taken under your account and agree to maintain the security of your login credentials.

2.2 Admin Responsibilities

As a DAPP user, you are responsible for managing your community’s members, staff, events, and financial transactions. This includes:

  • Ensuring all members invited to your community comply with RiserNest’s Community Guidelines.
  • Handling payments and bookkeeping related to community activities.
  • Managing events, voting, and issues submitted by members.
  • Adding and managing staff: Community managers may assign staff to assist in managing the community. You are fully responsible for the actions of any staff members added to DAPP or CAPP. This includes their conduct, the accuracy of information they provide, and their handling of members, events, or payments.
  • Inviting and managing Advisors: Admins may invite Advisors to provide consulting or advisory services within CAPP. Admins are fully responsible for verifying the eligibility of Advisors and ensuring that any advice or consulting provided is accurate, appropriate, and in compliance with community rules and applicable regulations. RiserNest is not responsible for the consulting or advice provided by Advisors.
  • Ensuring data security and privacy for all community members. You are fully responsible for implementing appropriate measures to protect members’ personal information and ensuring compliance with data protection laws applicable to your community. RiserNest is not responsible for any data breaches or privacy violations that occur within your community.

2.3 Voting Management

As an admin, you may create and manage votes within your community. You are responsible for:

  • Setting fair voting conditions.
  • Informing participants about the nature of the vote.
  • Ensuring votes are conducted in accordance with community rules.

2.4 Payment and Transaction Management

As a DAPP user, you may manage payments and transactions within your community (e.g., membership fees, event fees). Please note that RiserNest is not involved in any financial relationships between community admins and CAPP members. All payments, fees, and related matters, including refunds and disputes, are solely the responsibility of the community admin.

Admins must:

  • Accurately track and manage all financial transactions.
  • Handle refunds, disputes, and other financial concerns directly with the CAPP members.
  • Ensure that members are informed of the payment and refund policies applicable to the community.
  • RiserNest is not responsible for overseeing, facilitating, or resolving any financial transactions.

Disclaimer: Community managers are fully responsible for all financial relationships and must ensure that members’ data and financial information are handled securely. RiserNest disclaims any responsibility for financial disputes, data security breaches, or privacy violations within individual communities.

2.5 Content and Data Ownership

Content created within DAPP is owned by the community admin or company. RiserNest does not claim ownership of the content but may use it to provide and improve services.

2.6 Issue Resolution

DAPP users are responsible for addressing and managing issues raised by community members through the platform. You agree to respond promptly and professionally to reported issues.

2.7 Termination

RiserNest reserves the right to terminate your DAPP account for misuse or violation of these Terms, including failure to manage community members in accordance with our policies.

3. Terms for CAPP Users

The Community Application (CAPP) is a private social network where community members interact. This section applies specifically to CAPP users.

3.1 Account Registration

CAPP users may join only by invitation from a community admin. By creating an account, you agree to provide accurate information and maintain the security of your account credentials. Your account may be set to public or private based on your preferences.

3.2 Member Conduct

CAPP is designed to foster positive interactions between community members. You agree to:

  • Respect other members and their content.
  • Not engage in harassment, bullying, or abusive behavior.
  • Comply with community rules and guidelines set by your community admin.

3.3 Post Sharing and Interactions

CAPP users can share posts, comments, and engage in voting. You agree to:

  • Share content that is lawful and does not violate the rights of others.
  • Use the “uplifting,” sharing, and commenting features responsibly.
  • Follow privacy settings for other members’ posts.

3.4 Voting Participation

If you participate in community voting, you agree to:

  • Vote fairly and in accordance with the rules of the vote.
  • Abide by the outcomes of the vote, which are final.

3.5 Payments

CAPP members may be required to make payments for community membership fees, events, or other activities organized by their community. RiserNest is not responsible for handling these payments, refunds, or any related disputes. Any questions or issues related to membership payments, event fees, or refunds should be directed to the community admin or event organizer. The community is fully responsible for setting and enforcing its own policies regarding payments, fees, and refunds.

3.6 Privacy and Security

Your account privacy settings in CAPP allow you to choose between public and private profiles. Public profiles are visible to all community members, while private profiles require a follow request for access. You are responsible for managing your privacy settings.

3.7 Issue Submission

You may submit issues through CAPP for resolution by the community admin. You agree to provide accurate information when submitting issues and follow the appropriate channels for resolution.

3.8 Termination

RiserNest reserves the right to terminate your CAPP account if you violate these Terms or engage in behavior that harms the community.

4. General Terms for All Users

4.1 Content Ownership

You retain ownership of any content you create on RiserNest but grant us a non-exclusive, worldwide license to use, display, and distribute your content as necessary to provide the platform.

4.2 Prohibited Activities

You agree not to:

  • Post or share content that is illegal, harmful, or infringes on the rights of others.
  • Engage in fraudulent activities or misrepresentation.
  • Interfere with the operation of the platform or its security features.
  • Use RiserNest for any unlawful purposes.

4.3 Liability Limitation

RiserNest is provided “as is” and “as available.” We do not guarantee that the platform will be error-free or uninterrupted. RiserNest is not liable for any direct or indirect damages arising from your use of the platform.

4.4 Indemnification

You agree to indemnify and hold harmless RiserNest from any claims arising from your use of the platform or violation of these Terms.

4.5 Changes to the Terms

RiserNest reserves the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.

4.6 Disclaimer Regarding Community Content

Community managers are fully responsible for the content shared within the Community Application (CAPP). RiserNest is not responsible for any content shared, posted, or distributed by community members or admins within the CAPP platform. Community managers must ensure that all content complies with applicable laws and community guidelines.

5. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising from these Terms or the use of the platform will be resolved in the courts of the Netherlands.
